From reading the article, it sounds as if the plantiffs case is based on some pretty thin ground, and not even filed properly.
Either way, I would think common sense will prevail (and a little politics in our favor) with this B.S. suit.

From reading the article, it sounds as if the plantiffs case is based on some pretty thin ground, and not even filed properly. Both Ronnie's lawyer and the County Commission's lawyer say that the plaintiffs filed under the totally wrong procedure and statute and gave the judge case law to back it up. The plaintiff's lawyer sounded like he was backpedaling at times and he didn't seem particularly confident. He also said, which I took as a good sign, that he addressed some of the stuff the other two lawyers said and "cleaned up" his petition - therefore admitting he was missing things and/or was wrong. He insists that he filed under the right procedure and also gave the judge case law. I was not able to see any of that - it's last minute papers he gave to the judge right there in the courtroom and the judge took the whole file with him. Ronnie and a bunch of other people met with his lawyer afterwards and the lawyer wouldn't give any guarantees of course but he seems to be pretty confident.

This is pretty much a norm when it comes to landowners rights. The judge must be case sensitive as if he rules just on face value, it could be run thru a higher court, despite the fact some believe this cannot be appealed, case law is a funny item to tie down. Anything can be faught in higher places, if you have the money to fight. Greatest advise is, once this gets passed, do not wait to start the ground movement, it is very hard to stop anything once the ground is moving! , because if you sit , I'm sure something stupid could rear it's ugly head, like an endangered form of moss, or some long lost bones of ancient animal was born there. Then land has to be have a animal study done so as not to disturb the local animal kindom.

There was a case like this in Calif when I lives out there they wanted to build a Drag Strip at Glen Helen Regional Park and the suit was it would disturb the mating habits of the kangaroo mice and the judge required a 8 year study to see if it was going to be a problem, so for 8 years the environmentles counted mice in an open field, so needless to say the track never happen.
(and it was next to the 10 and the 15 FWY in san Berdo,CA Glen Helen Regional Park where the lanes are 8 lanes in each direction on the 15 fwy and 4 lanes wide each way on the 10 fwy.) I-70 is nothing compared to that place..
So my best advice is dont give up and if this judge says no go to higher court, cost the plaintiffs as much money as you can.

Im really excited to see this project move forward ....im not really familiar with how some people play ball in the judicial system .....but I do like the odds of this track happening.....

Well the clock is ticking, Law day for rulings is on Thursday this week.So we should here some good news from the JUDGE then. So everyone hang tight!!! It will be all over soon.
